"Service" refers to the legal advisory and representation services we provide. "User" or "you" refers to any person accessing our website or engaging our services. "Website" refers to the website hosted at https://foxglofix.club. "Agreement" refers to the engagement letter issued when a client retains our services.
2. Acceptance of Terms
By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or retain our services. You must be at least 18 years old to use this website or engage our services. By proceeding, you represent that you have the legal capacity to enter into a binding agreement.
3. Description of Services
Foxglove Legal provides legal advisory and support services in the following areas: agricultural land advisory (including land classification, leases, and conversion applications), adoption proceedings support (including court applications and hearing representation), and small claims tribunal preparation (including claim drafting and hearing coaching). Our services are primarily available to clients in Perak, Malaysia, though we may advise on federal-level legislation applicable nationwide.
4. Engagement and Retainer
Submission of the contact form on our website does not create a solicitor-client relationship. A formal engagement is only established when both parties sign a written engagement letter setting out the scope, fees, timeline, and terms of the retainer. Until such a letter is signed, no legal obligation arises on either side.
5. User Responsibilities
When using our website or engaging our services, you agree to provide accurate and complete information in any form submissions, to refrain from using our website for any unlawful or unauthorised purpose, not to attempt to interfere with the functionality or security of our website, and to comply with all applicable Malaysian laws in your use of our website and services.
6. Intellectual Property
All content on this website — including text, design, layout, graphics, and logos — is the property of Foxglove Legal or its licensors and is protected by Malaysian intellectual property law. You are granted a limited, non-transferable right to access and view the website content for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written consent.
7. Fees and Payment
Fees for our services are set out in the engagement letter provided to each client. All fees are quoted in Malaysian Ringgit (MYR). Payment terms and accepted methods will be specified in the engagement letter. We reserve the right to adjust fees for services not yet commenced, with reasonable notice. Any fee adjustments during an ongoing engagement will be discussed and agreed upon in writing.
8. Service-Specific Terms
Agricultural Land Advisory: Our advice is based on the information and documents you provide. We are not responsible for the accuracy or completeness of documents issued by third parties such as land offices or surveyors. Outcomes of applications to state authorities are subject to government discretion.
Adoption Proceedings: We will represent your interests and prepare your case to the best of our ability. However, adoption outcomes are determined by the court and depend on factors including the welfare assessment conducted by the Jabatan Kebajikan Masyarakat. We cannot assure any particular outcome.
Small Claims Tribunal: Our service covers preparation and coaching. As legal representation is not permitted at Tribunal for Consumer Claims hearings under Malaysian law, you will appear before the tribunal yourself. The outcome of the hearing is at the tribunal's discretion.
9. Disclaimers
The information on this website is provided for general informational purposes and does not constitute legal advice. No solicitor-client relationship is created by your use of this website. While we strive to keep the content accurate and current, we make no representations or warranties about the completeness or accuracy of the information provided. Individual legal matters should always be discussed directly with a qualified practitioner.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Foxglove Legal shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability in connection with any engagement shall not exceed the fees actually paid by you for that particular engagement. Nothing in these terms excludes liability for fraud, wilful misconduct, or any other liability that cannot be excluded under Malaysian law.
11. Indemnification
You agree to indemnify and hold harmless Foxglove Legal, its partners, employees, and agents from any claims, losses, or damages (including legal fees) arising from your breach of these Terms, your misuse of our website, or any inaccurate information you provide to us during an engagement.
12. Termination
Either party may terminate a legal engagement by providing reasonable written notice, subject to any ongoing court proceedings or filing deadlines. Upon termination, you remain responsible for fees incurred up to the date of termination. We will return all original documents to you and provide a final account of fees. Certain obligations (such as confidentiality) survive the termination of our engagement.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or in connection with these terms shall be subject to the jurisdiction of the courts of Malaysia, specifically the courts in Ipoh, Perak, unless otherwise agreed. We encourage parties to attempt informal resolution of any disputes before pursuing formal legal proceedings.
14. General Provisions
These Terms and Conditions, together with any applicable engagement letter, constitute the entire agreement between you and Foxglove Legal. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right or provision shall not constitute a waiver of that right. We may not assign or transfer our obligations under these terms without your consent, except in the context of a firm restructure or succession.
15. Changes to These Terms
We reserve the right to update these Terms and Conditions from time to time. Changes will be posted on this page with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
